1. TERMS & CONDITIONS / TERMS OF SALE

   These Terms & Conditions / Terms of Sale ("Terms") govern access to and purchases made through Aircraft Reports, a website and online service operated by Sicuro Publishing Inc., a corporation incorporated under the laws of Canada.

   By accessing the Aircraft Reports website, creating an account, placing an order, or purchasing or downloading digital material through the website, you acknowledge that you have read and accepted these Terms.

   Nothing in these Terms is intended to exclude, restrict or waive any right, remedy, warranty or protection that cannot lawfully be excluded, restricted or waived under applicable law.

   1. About Aircraft Reports

   Aircraft Reports provides access to aviation-related documentation and information in digital form.

   Depending on the product, the material may include historical and technical publications such as:

   • aircraft manuals;

   • engine and powerplant manuals;

   • component and equipment manuals;

   • maintenance and overhaul publications;

   • illustrated parts catalogues;

   • service and technical publications;

   • military technical publications;

   • engineering drawings and construction drawings;

   • blueprints;

   • inspection and maintenance information;

   • aircraft reports and research material;

   • photographs and other archival material; and

   • collections or compilations of related aviation documentation.

   Products may originate from different periods, manufacturers, operators, government agencies, military organizations, archives, libraries, private collections or other historical sources.

   The nature and provenance of a particular product should be determined from its individual product description and accompanying information.

   2. Nature and Purpose of the Documentation

   Unless expressly stated otherwise in the product description, material supplied by Aircraft Reports is provided primarily for historical research, reference, educational, restoration, archival and documentary purposes.

   Historical aviation documentation may reflect the engineering standards, terminology, practices, regulations and technical knowledge applicable at the time of its original publication.

   The presence of a document on Aircraft Reports does not mean that the document represents current aircraft maintenance, operating, engineering, certification or airworthiness requirements.

   Customers are responsible for determining whether any information remains applicable to their particular aircraft, component, project or intended use.

   Where current regulatory, maintenance, engineering or airworthiness information is required, customers should consult the applicable aircraft manufacturer, type-certificate holder, competent aviation authority, approved maintenance organization, licensed engineer or other appropriately qualified professional.

   3. Product Descriptions

   Aircraft Reports makes reasonable efforts to describe products accurately, including their title, subject, aircraft or component applicability, publication information, page count and other characteristics where such information is available.

   Historical material may contain imperfections inherent in the original source, including:

   • missing pages;

   • damaged or deteriorated pages;

   • handwritten annotations;

   • illegible portions;

   • printing defects;

   • incomplete publications;

   • outdated terminology;

   • typographical errors; or

   • other characteristics of the original document.

   Where a known limitation materially affects the usefulness or completeness of a product, Aircraft Reports will endeavor to disclose it in the product description.

   A digital reproduction may not reproduce every physical characteristic of an original publication.

   4. Orders and Acceptance

   An order placed through the Aircraft Reports website constitutes an offer to purchase the selected product.

   An order is accepted when payment has been successfully processed and Aircraft Reports confirms the order or makes the purchased digital material available for delivery.

   Aircraft Reports reserves the right to decline or cancel an order where there is a reasonable basis to do so, including suspected fraud, payment problems, technical errors, duplicate orders, pricing errors or circumstances in which the product cannot reasonably be supplied.

   If an order is cancelled after payment has been received, the applicable payment will be refunded unless otherwise permitted or required by law.

   5. Prices and Payment

   Prices are displayed on the website in the currency indicated at the time of purchase.

   Prices may change without notice; however, a price change will not affect an order that has already been accepted.

   Payment must be completed through the payment methods made available during checkout.

   Aircraft Reports does not store complete payment-card information where payment processing is handled by an independent payment service provider. Payment information may be processed by third-party payment providers in accordance with their own terms and privacy practices.

   6. Digital Delivery

   Products purchased through Aircraft Reports are generally supplied electronically.

   Delivery may occur through:

   • an electronic download;

   • a customer account;

   • a download link;

   • email; or

   • another electronic method specified at the time of purchase.

   The customer is responsible for providing an accurate email address and for maintaining reasonable access to the email account or customer account used for the purchase.

   If a customer experiences a genuine technical problem preventing access to a purchased product, Aircraft Reports will make reasonable efforts to restore access or provide an alternative method of delivery.

   A customer should contact Aircraft Reports promptly if a purchased product cannot be accessed or downloaded.

   7. Digital Products, Cancellations and Refunds

   Because digital products can generally be copied, downloaded or accessed electronically, purchases of digital documentation are normally considered final once the product has been supplied or made available for download.

   However, this policy does not exclude any cancellation right, refund, statutory warranty, remedy or other protection that applies under mandatory applicable law.

   Aircraft Reports may, at its discretion, provide a refund, replacement or alternative product where:

   • a product is materially different from its description;

   • the wrong product was supplied;

   • the supplied file is materially defective;

   • the customer cannot reasonably access the purchased product because of a technical problem attributable to Aircraft Reports; or

   • another circumstance justifies a remedy.

   Requests concerning defective, incorrect or materially misdescribed digital products should be sent to Aircraft Reports as soon as reasonably possible after discovery of the problem.

   Nothing in this section limits rights that cannot legally be limited under applicable consumer-protection law.

   8. Intellectual Property and Use of Purchased Material

   Unless otherwise stated, the Aircraft Reports website, including its design, original text, product descriptions, databases, compilations, photographs created or commissioned by Aircraft Reports, graphics, logos and other original website content, is protected by applicable intellectual-property laws.

   A purchased digital document is supplied to the customer under a limited, non-exclusive, non-transferable right to use the material for the customer's own lawful research, reference, educational, restoration, archival or professional purposes, subject to any additional rights or restrictions applicable to that particular material.

   Unless expressly authorized, customers may not:

   • resell a purchased digital file;

   • redistribute or publicly upload the complete digital publication;

   • place the purchased file in a public download repository;

   • reproduce and commercially distribute the publication as a competing product;

   • represent Aircraft Reports' digital copy or compilation as their own work; or

   • systematically copy or redistribute substantial portions of the Aircraft Reports catalogue.

   Nothing in these Terms is intended to transfer ownership of underlying intellectual-property rights that Aircraft Reports does not own.

   Where a publication originates from a third party, historical archive, government source, manufacturer, private collection or other rights holder, rights in the underlying material may remain with the applicable rights holder.

   9. Historical and Archival Material

   Aircraft Reports may reproduce material that was originally published many years or decades ago.

   The appearance of a historical document in the Aircraft Reports catalogue should not, by itself, be interpreted as a representation that:

   • the document is currently approved for operational use;

   • the document remains current;

   • the information complies with present-day aviation regulations;

   • the aircraft, component or system described remains airworthy;

   • the publication is an official current publication of the original manufacturer or authority; or

   • the document supersedes current technical, regulatory or maintenance information.

   Customers using historical material for an operational, engineering, restoration or certification purpose are responsible for independently verifying its applicability and current status.

   10. Accuracy and Reliance

   Aircraft Reports makes reasonable efforts to identify, catalogue, digitize and describe the material it offers.

   However, Aircraft Reports does not warrant that every historical document or piece of information is complete, current, error-free or suitable for a particular technical purpose.

   Historical documentation may contain information that was subsequently revised, corrected, superseded or rendered obsolete.

   Aircraft Reports should not be considered the authoritative source for current airworthiness, certification, maintenance or regulatory requirements unless a particular product is expressly identified as such.

   Customers should exercise appropriate professional judgment before relying upon historical documentation in circumstances involving safety, airworthiness, certification or regulatory compliance.

   11. No Professional Engineering or Regulatory Advice

   The sale or provision of documentation by Aircraft Reports does not constitute engineering, maintenance, inspection, certification, legal, regulatory or other professional advice.

   Aircraft Reports does not certify an aircraft, component, repair, modification or restoration project merely by providing historical documentation relating to it.

   Nothing on the Aircraft Reports website should be interpreted as a substitute for applicable current regulations, approved technical data, airworthiness directives, service information, certification records or advice from an appropriately qualified professional.

   12. Third-Party Material and Sources

   Some material available through Aircraft Reports may originate from or relate to third parties.

   Aircraft Reports may identify manufacturers, aircraft owners, operators, government agencies, archives, publications or other historical sources in product descriptions for purposes of identification and research.

   Such references do not necessarily imply current affiliation, endorsement, sponsorship or authorization by the referenced organization.

   Aircraft Reports does not claim ownership of third-party trademarks, trade names or other intellectual property belonging to their respective owners.

   13. Website Availability

   Aircraft Reports endeavors to maintain reliable access to its website and digital services but does not guarantee uninterrupted or error-free availability.

   Access may occasionally be affected by maintenance, hosting problems, network interruptions, security measures, software failures, third-party services or circumstances beyond the Company's reasonable control.

   Temporary interruption of website access does not affect a customer's ownership of a properly purchased digital product, and Aircraft Reports will make reasonable efforts to restore access where appropriate.

   14. Accounts and Security

   Where customer accounts are available, customers are responsible for maintaining the confidentiality of their account credentials and for notifying Aircraft Reports of suspected unauthorized access.

   Customers must not use the website or their account for unlawful activity, fraudulent transactions, unauthorized distribution of purchased material, automated abuse, or activity intended to interfere with the operation or security of the website.

   Aircraft Reports reserves the right to suspend or restrict access where reasonably necessary to protect the website, its customers or its intellectual property, subject to applicable law.

   15. Privacy

   Aircraft Reports may collect and use personal information necessary to process orders, provide digital products, communicate with customers, maintain accounts, prevent fraud, provide customer support and operate the website.

   Personal information will be handled in accordance with applicable privacy legislation and Aircraft Reports' Privacy Policy.

   Customers should refer to the Aircraft Reports Privacy Policy for additional information regarding the collection, use, retention and disclosure of personal information.

   16. Limitation of Liability

   To the maximum extent permitted by applicable law, Aircraft Reports and Sicuro Publishing Inc. will not be liable for indirect, incidental, consequential, special or punitive damages arising from or related to the use of the website or purchased documentation.

   Without limiting the foregoing, Aircraft Reports is not responsible for losses arising from a customer's reliance upon historical or technical documentation for an application for which the documentation was not intended or for which current verification was required.

   Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

   17. Indemnification

   To the extent permitted by applicable law, a customer agrees to be responsible for losses, claims or reasonable costs arising from the customer's unlawful use of the Aircraft Reports website or unauthorized redistribution or commercial exploitation of purchased material.

   This provision does not apply to the extent that the relevant loss or claim results from the negligence, wilful misconduct or other liability of Aircraft Reports that cannot lawfully be excluded.

   18. Changes to These Terms

   Aircraft Reports may update these Terms from time to time to reflect changes in its services, website, business practices or applicable legal requirements.

   The current version will be posted on the Aircraft Reports website with its effective or updated date.

   Changes will not retroactively alter rights or obligations arising from an order already completed, except where required by law or necessary to give effect to a legal requirement.

   19. Governing Law

   These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada, without regard to conflict-of-law principles.

   Where applicable consumer-protection legislation gives a customer rights or remedies that cannot lawfully be excluded by contract, those rights remain unaffected.

   Any dispute will be subject to the jurisdiction of the courts having appropriate jurisdiction in Ontario, Canada, subject to any mandatory jurisdictional rights available to a consumer under applicable law.

   20. Severability

   If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permissible.

   The remaining provisions will continue in full force and effect.

   21. Entire Agreement

   These Terms, together with the applicable product description, order information, Privacy Policy and any other terms expressly incorporated into the purchase process, constitute the agreement between the customer and Aircraft Reports concerning the applicable purchase and use of the website.

   If there is a conflict between these Terms and a mandatory provision of applicable law, the mandatory provision will prevail.
