LIMITATION OF LIABILITY

Aircraft Reports provides historical aviation documentation, technical publications, reports, drawings and related digital material primarily for research, reference, educational, historical, archival and restoration purposes.

1. Use of Historical and Technical Documentation

Customers are responsible for determining whether information obtained from Aircraft Reports is suitable and applicable to their particular purpose.

Historical aviation documentation may contain information that is outdated, incomplete, superseded, technically obsolete or specific to an earlier configuration, aircraft, component, manufacturer or regulatory environment.

Aircraft Reports does not represent that historical documentation constitutes current approved technical data, current maintenance instructions, current airworthiness information, engineering advice or regulatory guidance unless expressly stated otherwise.

Customers should obtain and rely upon appropriate current technical, regulatory and professional advice where safety, airworthiness, certification or regulatory compliance is involved.

2. Limitation of Liability

To the maximum extent permitted by applicable law, Sicuro Publishing Inc., Aircraft Reports, and their respective directors, officers, employees and representatives shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business opportunities, data or use, arising from or relating to:

• the use of, or reliance upon, documentation or information obtained through Aircraft Reports;

• the inability to access the website or a purchased digital product;

• the use, restoration, maintenance, modification or operation of an aircraft, engine, component or other equipment based upon information obtained from Aircraft Reports; or

• the use of third-party websites or services accessed through links provided on the Aircraft Reports website.

This limitation applies whether a claim is based on contract, negligence, tort or another legal theory, to the extent permitted by applicable law.

3. Maximum Extent Permitted by Law

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.

Nothing in these Terms limits any mandatory consumer right, statutory remedy or other protection that applies under applicable law.

Where applicable law does not permit a particular limitation or exclusion, that limitation or exclusion will apply only to the maximum extent legally permitted.

4. Third-Party Websites and Services

Aircraft Reports may provide links to websites, archives, manufacturers, government resources, payment providers or other third-party services.

Aircraft Reports does not control and is not responsible for the content, availability, accuracy, security or practices of third-party websites or services.

Accessing a third-party website is at the customer's own discretion and subject to the terms and policies of that third party.

5. Digital Products

Aircraft Reports makes reasonable efforts to provide purchased digital products in the form described at the time of purchase.

If a purchased product is materially defective, inaccessible or materially different from its description, customers should contact Aircraft Reports so that we can investigate the problem and, where appropriate, provide a replacement, corrected file or other remedy.

Nothing in this section limits any right or remedy that cannot lawfully be excluded.

6. No Waiver of Legal Rights

These limitations are intended to protect Aircraft Reports and Sicuro Publishing Inc. only to the extent permitted by applicable law.

If any provision of this Limitation of Liability is found to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
