EXPORT CONTROL & DISTRIBUTION NOTICE

Aircraft Reports, operated by Sicuro Publishing Inc., provides access to a large collection of historical aviation documentation originating from different periods, manufacturers, government agencies, military organizations, archives and private collections.
Some documents in the Aircraft Reports catalogue may contain original export-control, distribution-control, handling or other restrictive markings.
Customers should not assume that such a marking can be ignored simply because the document is old, has been commercially reproduced, or is available through Aircraft Reports.
1. Customer Responsibility
Customers are responsible for complying with export-control and other applicable laws and regulations relating to any document they purchase, download, possess, transfer, re-export or otherwise make available to another person.
This responsibility may apply differently depending on:

the origin of the document;
-
the country from which it is exported or re-exported;
-
the destination country;
-
the nationality or status of the recipient;
-
the nature of the technical information;
-
the original distribution marking;
-
the intended end use and end user; and
-
the laws and regulations applicable to the particular transaction.

2. U.S. Export-Controlled Material
Some aviation and military technical information originating in the United States may be subject to U.S. export-control laws and regulations.
Depending on the particular material and circumstances, applicable U.S. controls may include the International Traffic in Arms Regulations (ITAR) administered by the U.S. Department of State or the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce, Bureau of Industry and Security (BIS).
The current U.S. regulatory framework should be consulted when determining whether particular technical information is subject to export controls and whether a license, authorization, exemption or other exception is required.
3. Original Distribution Statements and Warnings
Historical documents may contain original government or military distribution statements, export-control warnings or other restrictions.
Examples may include documents bearing Distribution Statements B, C, D, E or F, or other government markings.
These markings are part of the historical document and should be retained when the document is reproduced or distributed where appropriate.
The presence of an historical marking does not, by itself, establish the current legal status of the document.
Conversely, the absence of a current restriction from Aircraft Reports' product description should not be interpreted as a determination that no export or distribution restriction applies.
Aircraft Reports does not independently certify the current export-control classification or legal status of every historical document in its catalogue.
4. Historical Documents and Current Restrictions
A document may have been created, marked or distributed under laws, regulations or government policies that have subsequently changed.
Accordingly, an original marking appearing on a historical publication may require additional examination to determine its present legal effect.
Customers who intend to export, re-export, transfer or otherwise distribute potentially controlled technical information should independently determine the current legal requirements applicable to that particular material and transaction.
Where appropriate, customers should seek advice from qualified export-control counsel or the relevant government authority.
5. Further Distribution
Purchasing a digital copy from Aircraft Reports does not automatically grant the purchaser a right to further distribute, publish, resell or export the underlying technical information.
Customers must comply with both:

any applicable intellectual-property or copyright restrictions; and
-
any applicable export-control, distribution or other legal restrictions.
Nothing in the sale of a document by Aircraft Reports should be interpreted as authorization from the United States Government, a manufacturer, a government agency or any other third party to further distribute controlled material.
6. International Customers
Aircraft Reports serves customers internationally.
Customers located outside the United States are responsible for complying with the laws applicable to their own country as well as any applicable laws governing the export or re-export of controlled information.
A customer should not assume that a document can be freely transferred from one country to another merely because the document can be purchased or downloaded from Aircraft Reports.
7. Government and Law-Enforcement Requests
Aircraft Reports will comply with valid legal obligations and lawful requests from competent government or law-enforcement authorities.
Where disclosure of information is required or permitted by applicable law, Aircraft Reports may provide information reasonably necessary to comply with that legal obligation.
